Terms and Conditions

1. Purpose

These Terms and Conditions govern the contractual relationship between Elite Pacific (Audrey Sidoen, ABN 41 141 525 158) and any person (the client) purchasing a service offered on elitepacific.com.au: the WHV support packages (Essential, Smart, Premium, Custom Plan) and the targeted sessions (Strategy Call, Australia Job Pack).

2. Description and pricing of services

Service details and current pricing are set out on the Services page of the website. Prices are in Australian dollars (AUD). Elite Pacific reserves the right to change its prices at any time; the price applicable is the one in effect at the time of booking or signing.

3. Nature of the service

Elite Pacific provides informative, administrative and logistical support. This service does not constitute migration advice under Australian regulatory law and does not replace a registered MARA agent for any matter requiring migration advice. Elite Pacific commits to a best efforts obligation (applying the necessary skill and diligence), not an obligation of result: obtaining a visa or employment depends on factors outside Elite Pacific's control, including decisions made by Australian authorities, the job market, and the client's individual circumstances.

4. Booking and payment for targeted sessions

Applies to the Strategy Call and the Australia Job Pack. Full payment is required at the time of booking and confirms the appointment.

A free reschedule is available once, provided it is requested at least 48 hours before the scheduled call. After this window, or in case of a no show without prior notice, the session is considered delivered: it is neither refunded nor automatically rescheduled. A new booking requires a new payment.

In line with the regulations applicable to consumers based in New Caledonia or France, if the session is scheduled less than 14 days after payment, by confirming the booking the client expressly requests that the service be performed before the end of the 14 day statutory withdrawal period and waives that right once the session has been fully delivered. If the client withdraws before the session takes place, they may request a refund, as no service has yet been performed at that stage.

5. Support packages and deposit

A non refundable $250 deposit is required at signing to begin preparing the client's file (initial review, calendar hold, start of administrative steps). The balance is due upon visa approval.

By signing and paying the deposit, the client expressly requests that the service begin immediately, before the end of the 14 day statutory withdrawal period, and acknowledges that the deposit covers work already undertaken by Elite Pacific at that point, which is why it is non refundable once work has started.

Services delivered after the client's arrival in Australia (accommodation, bank appointment, account setup, ongoing support, etc.) are performed on Australian territory and are, accordingly, also covered by the guarantees provided under the Australian Consumer Law.

6. Cancellation by Elite Pacific

Should Elite Pacific need to cancel or reschedule an appointment, a new date will be offered at no extra cost to the client, or a full refund will be issued if no suitable date can be found.

7. Liability

Elite Pacific cannot be held responsible for decisions made independently by the client, visa refusals, processing times imposed by Australian authorities, or any matter beyond its reasonable control.

8. Personal data

Data submitted by the client is used solely within the scope of the contractual relationship and is not shared with third parties for commercial purposes. See the Legal Notice for more detail.

9. Complaints and disputes

For any complaint, the client can contact Elite Pacific at audrey@elitepacific.com.au. Elite Pacific commits to responding within a reasonable timeframe and to seeking an amicable resolution before any further action.

10. Governing law

These Terms and Conditions are governed by the law of Queensland, Australia, without prejudice to any mandatory consumer protection provisions applicable to New Caledonia residents at the time of purchase, which cannot be excluded by contract where required by law.
